'Two fumbles and you're banned' under aggressive new legislation.

On Monday 24th September the number of penalty points for 'failing to identify the driver' jumps from 3 to 6. This means that drivers will be banned just for fumbling the paperwork, says Idris Francis.

Idris Francis took his 'right to silence' case all the way to the ECHR Grand Chamber last June. The case was lost, which he considers is extremely unfortunate for Britain's 34 million motorists.

Commenting on the changes, Idris Francis (independent campaigner) said: "Imagine the circumstances where your son has been driving your car. You get a couple of notices in the post because your son has been photographed by a speed camera. If you fumble the notices and fail to return them in the 28 days allowed you are almost certain to be banned from driving for 6 months under these crazy new rules. This isn't road safety - this is spite - pure and simple."

"The new rules also cause duress. Parliament decided in 1988 that those who do not know should not be penalised for failing to do what they were unable to do, but under the new rules few if any will be brave or foolish enough to use that defence, especially those who already have 6,7 or 8 penalty points who would lose their licenses for failing to identify but keep them if they admit the driving offence."
