Appeal confirms Ceccon’s Budapest Auto GP win

 Below is the decision wording: The National Court of Appeal amends the decision n°1 made by the Stewards of the Auto GP event on 4th June, 2011 and confirming the facts stated by the Stewards decides to amend the time penalty from 60 seconds to 25 seconds.Pursuant to this decision the position of driver n°5, Kevin Ceccon (competitor: Ombra Racing S.r.l.) in Race 1 is to be determined by adding 25 seconds to the time achieved by the driver actually during the race. The National Court of Appeal made its decision on the basis of Art. XIII, Point 189 of the International Sporting Code, considering also the 2011 Sporting Regulations of Auto GP, Points 47-51 (Accidents).REASONSBased on the available documents the National Court of Appeal came to the conclusion that the above named driver violated the rules foreseen in Point 145 of the 2011 Sporting Regulations of Auto GP for the case of the deployment of the Safety-Car. Accordingly the Stewards of the event were right to judge the case as a violation of the rules by the driver. This fact was not influenced by the circumstances which were referred into the appeal.As a penalty for the violation of the rules the Stewards of the event imposed a time penalty of 60 seconds. In the 2011 Sporting Regulations of Auto GP – in points 47-51 – the applicable penalties are exactly specified. According to the penalties listed there, it is not possible to impose a time penalty of 60 seconds. Due to this fact the National Court of Appeal applied the “stop and go” penalty with the stipulation that, as this penalty was not applicable during the race, according to point 49b a time penalty of 25 seconds was imposed.
